1. Acceptance of Terms

By accessing or using Income Investor ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and The Dividend Standard. We reserve the right to modify these Terms at any time, with notice provided via email and on this page.

3. Service Description

Income Investor provides:

• Dividend safety scoring based on publicly available financial metrics
• Email alerts for score changes and earnings updates
• Portfolio analysis tools for dividend investors
• Specialized scoring for REITs, BDCs, and MLPs

We reserve the right to modify, suspend, or discontinue any feature at any time without notice.

4. User Accounts

4.1 Account Creation

• You must be at least 18 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining account security
• You may not share your account credentials

4.2 Account Termination

• You may close your account at any time from account settings
• We may suspend or terminate accounts for Terms violations
• No refunds for partial subscription periods upon termination

5. Subscription and Billing

5.1 Subscription Tiers

• Free Plan: 150 total dividend safety scores, up to 10 holdings
• Income Investor Pro ($15/month): daily dividend safety scoring, unlimited holdings, stress testing

5.2 Payment Terms

• Subscriptions are billed monthly in advance
• Payment processed via Stripe (PCI DSS compliant)
• Automatic renewal unless canceled before billing date
• How to cancel: Cancel anytime from your account billing settings, or via the Stripe customer portal link in your billing emails. Cancellation takes effect at the end of the current billing period — you keep Pro access until then.
• Price changes take effect at next billing cycle with 30-day notice

5.3 Refund Policy

• 14-Day Money-Back Guarantee: First-time subscribers may request a full refund within 14 days of their initial purchase. This guarantee applies once per customer and is not available to users who have previously received a refund.
• Eligibility: Refund requests are subject to fraud review. Users with multiple accounts, previously refunded accounts, or suspicious activity patterns may be denied.
• Renewals: No refunds for subscription renewals (cancel before renewal date)
• Service Issues: Refunds considered for prolonged service outages (>24 hours)

6. Acceptable Use Policy

You agree NOT to:

• Abuse the API: Excessive requests, scraping, or automated access beyond reasonable use
• Share Accounts: Sharing login credentials or subscription access
• Reverse Engineer: Attempting to derive our scoring algorithms or source code
• Resell Data: Redistributing scores or data commercially without permission
• Malicious Activity: Hacking, DDoS attacks, or security testing without authorization
• False Information: Creating accounts with fake or misleading information

Violation Consequences: Account suspension or termination without refund.

7. Data Accuracy

• We source data from public APIs (yfinance) and make reasonable efforts to ensure accuracy
• We do NOT guarantee data accuracy, completeness, or timeliness
• Errors may occur due to third-party API issues, data delays, or calculation bugs
• Always verify data from official sources (SEC filings, company websites)
• Report data issues to support@income-investors.com for review

8. Intellectual Property

8.1 Our Rights

Income Investor owns all rights to:

• Scoring algorithms and methodologies
• Website design, UI/UX, and code
• Brand names, logos, and trademarks
• Proprietary analysis and reports

8.2 Your Rights

• Personal Use: You may use scores and reports for personal investment research
• Limited Sharing: Sharing individual scores with your financial advisor is permitted
• Commercial Use Prohibited: Republishing, reselling, or commercial distribution requires written permission

You agree to indemnify and hold harmless Income Investor from any claims, damages, or expenses arising from:

• Your investment decisions based on our data
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Unauthorized use of your account by others

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Governing Law

These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles. Any disputes will be resolved in the courts of [Your Jurisdiction].

13. Dispute Resolution

• Informal Resolution: Contact support@income-investors.com first to resolve disputes
• Arbitration: If informal resolution fails, disputes will be resolved via binding arbitration
• Class Action Waiver: You agree to arbitrate disputes individually, not as a class action

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
